Wrongful death lawsuit depositions from 2004 pub crawl start this week

DeCandido, Rocheleau, Welsh, Sturgeon, Tremblay's bus company, the Rhino Bar and Grille, the Newport Blues Cafe and the city of Newport are all named as defendants in the lawsuit. DeAndrade is not.

According to the lawsuit, "DeCandido negligently failed to take reasonable steps to ensure the safety, security and welfare of pub crawl attendees and the individuals at large with whom pub crawl attendees would come in contact with."

Throughout this week and the next, various witnesses and people involved with the incident will come to Parrillo's Providence office for questioning. This sworn testimony will be recorded by a stenographer just as if the person were on the stand in court. At times, this testimony may be used in place of the witness in court.

This process is one of the ways a court case is prepared for trial.

After testimony is taken, Parrillo will use that evidence in court to support Marx's parents' case.

"We are trying to achieve and learn the facts from the various parties and witnesses that have knowledge about that situation," Parrillo said.

Parrillo said the case will eventually go to court, but cannot predict at this point the exact date.
